ICMR Partnership with Bill & Melinda Gates Foundation Faces Ethical Scrutiny, Sovereignty Concerns

The Indian Council of Medical Research (ICMR) has engaged in a collaborative agreement with the Bill & Melinda Gates Foundation (BMGF) for health research, signed on March 12, 2024. This Letter of Agreement (LoA) aims to support and promote mutually beneficial health research aligned with India’s health priorities


The LOA aims to formalize cooperation between the Indian Council of Medical Research (ICMR) and the Bill & Melinda Gates Foundation (BMGF) to support health research that aligns with India’s critical health priorities as established in a prior Memorandum of Cooperation (MoC) signed on October 18, 2019 (before the COVID plandemic), for five years.

The key areas of scientific and technological cooperation include:
– Communicable diseases such as:
– Enteric and diarrheal diseases
Vector-borne diseases
– Neglected tropical diseases
– Pneumonia
– Tuberculosis
– Polio
– HIV
– Family planning
– Maternal, newborn, and child health and nutrition research
– Disease modeling
Artificial Intelligence and data analytics in health research
– Telemedicine for rural healthcare access
– Development of research capacity and capabilities
Innovations in routine immunization and disease surveillance
– Information Technology applications for healthcare

How will ICMR and BMGF promote their collaboration?
They will promote cooperation through:
– Joint funding for mutually identified research proposals/projects.
– Exchange programs for scientists aimed at capacity building and skills development.
– Co-sponsorship of scientific information dissemination through lectures, workshops, and publications.
– Ensuring information and knowledge from funded projects are made available at affordable prices, particularly in India and for those in need globally.
– Establishing fair processes to manage intellectual property rights (IP) arising from joint activities.

What is the structure established for program oversight?
A Joint Steering Committee, comprising equal members from both Parties, will oversee the progress of the collaboration and recommend mechanisms for continued program support.

Is the LOA legally binding?
No, the LOA is not legally binding in terms of funding obligations or commitments. It serves as a framework for cooperation, remaining in effect as long as the MoC between the involved parties is valid.

What are the provisions for termination of the LOA?
Any party can terminate its participation by providing six months’ written notice. However, ongoing activities agreed upon before the termination date will not be affected unless otherwise decided by the parties.

How will disputes and confidential information be managed?
Dispute settlement, confidentiality, intellectual property rights, financial provisions, and other relevant terms will continue to be governed by the original MoC framework.

What measures are in place for project sustainability after LOA termination?
Termination of the LOA will not impact implementation of activities that have been agreed upon prior to termination, ensuring continuity in ongoing programs.

Maharashtra Chief Minister Devendra Fadnavis announced a collaboration between the Gates Foundation and the Maharashtra government aimed at making the state malaria-free. This initiative aligns with the Foundation’s broader mission of improving global health, reducing poverty, and expanding education.

Bill Gates engaged in discussions regarding several strategic initiatives with Fadnavis, focusing on artificial intelligence (AI) in the fields of health, agriculture, and infrastructure development.

Fadnavis shared a vision for Maharashtra aimed at making it a model for digital governance, enhancing citizen access and service delivery for citizens.

The vaccine’s development is a collaboration between the Indian Council of Medical Research (ICMR) and the Department of Biotechnology-National Institute of Immunology (DBT-NII), aligning with the national initiative to promote indigenous solutions under the “Make in India” program.

ICMR is planning to license the technology behind AdFalciVax to qualified organizations and manufacturers. This will be executed through non-exclusive agreements aimed at fostering broader outreach and maximizing the public health benefits of the vaccine candidate.

Currently, the public is informed and does not wish for the Indian government to serve as a platform for Gates’ experimental research program.
