FASTag and Beyond: The RBI’s Guidelines Stand Against Forced Digital Transactions and Cash Surcharges

Date:

India has seen a significant push towards digital payments, with the government encouraging citizens to adopt cashless modes of transaction. However, there are legal limits to the government’s ability to mandate digital payments and impose surcharges on cash transactions. This article will explore the relevant laws and regulations that govern the use of digital payments and cash transactions in India, with a focus on the use of FASTag at toll plazas.

The Indian government cannot make mandatory the use of digital payments and cannot impose surcharges on cash transactions. This is because of the fundamental right to property enshrined in the Indian Constitution, which includes the right to choose the mode of payment.

The RBI has also clarified that merchants cannot force customers to use digital payments and cannot charge extra for cash transactions. This is because the RBI’s guidelines prohibit merchants from discriminating between different modes of payment and from imposing surcharges on customers who choose to use cash.

FASTag and Toll Plazas

FASTag is an electronic toll collection system that uses Radio Frequency Identification (RFID) technology to enable automatic deduction of toll fees from a prepaid account linked to the tag. The National Highways Authority of India (NHAI) has made FASTag mandatory for all vehicles passing through toll plazas on national highways. The ‘One Vehicle, One FASTag’ initiative is introduced to boost toll collection efficiency and discourage misuse or multiple FASTags linked to a single vehicle.

What if the FASTag Machine is not working at the toll?

In case the equipments are not working and your FASTag account is having sufficient balance, please pay the toll fee in cash at the plaza. Additionally, please call on 1033 toll free number and register the complaint on centralize call center set up by NHAI (Gov. of India) about the issue at the toll plaza.

While digital payments offer convenience, they shouldn’t come at the expense of our fundamental rights and fair practices. The Reserve Bank of India (RBI) Act, which was established in 1934, controls how money is made and used in India.

NHAI Mandates: No cash payment allowed; double user fee for non-FASTag vehicles

A consumer forum in Vadodara has said that the National Highways Authority of India (NHAI) toll plaza cannot charge double the toll fee if the FASTag pasted on any vehicle is non-functional.

The FASTag system was introduced to streamline toll collection and reduce congestion at toll plazas. While intended to be convenient, it’s not without its issues. What happens when your FASTag malfunctions or isn’t read properly at a toll plaza?

According to the National Highways Authority of India (NHAI) rules and regulations, if a FASTag isn’t working due to technical issues on their end, or the tag is blacklisted for no fault of the user, the toll plaza operator cannot charge double the toll.

Here’s the relevant legal framework:

  • National Highways Fee (Determination of Rates and Collection) Rules, 2008: These rules govern the collection of toll fees on national highways. While they don’t specifically address FASTag malfunctions in detail, they lay the groundwork for fair and transparent toll collection procedures.
  • NHAI Circulars and Guidelines: NHAI regularly issues circulars and guidelines related to FASTag implementation. These often clarify procedures for handling situations where FASTags are not working.

What to Do When Your FASTag Fails at a Toll Plaza:

  1. Document the Issue: If your FASTag fails, immediately inform the toll plaza operator. Take pictures or videos of the error message on the device scanning your FASTag. Note the date, time, location, and lane number.
  2. Demand a Manual Transaction: You are entitled to pay the standard toll amount in cash if the FASTag system malfunctions. Insist on paying with cash and obtain a receipt.
  3. Refuse to Pay Double: Under no circumstances should you pay double the toll amount if the fault lies with the FASTag system or the toll plaza’s equipment.
  4. Register a Complaint: If the toll plaza operator insists on charging double, pay the amount under protest and obtain a receipt clearly stating that it was paid under protest. Then, immediately register a complaint with the NHAI. You can do this through:
    • The NHAI website: https://www.nhai.gov.in/
    • The NHAI helpline: 1033
    • The MyFASTag app: Available on both Android and iOS.

Key Takeaways:

  • The right to use cash is protected by law. The government cannot mandate a completely cashless society.
  • You are not obligated to pay double the toll if your FASTag malfunctions due to technical reasons.
  • Document everything and register a complaint with NHAI if unfairly charged.

By understanding your rights and knowing the appropriate course of action, you can navigate the complexities of FASTag and ensure a smoother travel experience. Remember, staying informed is key to safeguarding your interests in an evolving digital landscape.
