Sonam Wangchuk’s Detention: Supreme Court Demands Government Response

Date:

Gitanjali J. Angmo, wife of climate activist Sonam Wangchuk, has filed a habeas corpus petition in the Supreme Court of India challenging her husband’s detention under the National Security Act (NSA). The Supreme Court is scheduled to hear the plea on October 6, 2025, and granted her permission to meet Mr. Sonam Wangchuk in jail, posting the next argument for October 14, 2025.

Gitanjali’s petition seeks her husband’s immediate release, stating that she has no information about his health, condition, or the grounds for his detention since his arrest on September 26, 2025. Sonam Wangchuk was detained under the NSA following violent protests in Leh on September 24, which resulted in four deaths. She has rejected allegations linking her husband to Pakistani intelligence operatives as baseless and has accused the Ladakh police of having an agenda against implementing the Sixth Schedule in Ladakh. Gitanjali argues that Sonam’s arrest is mala fide and intended to suppress democratic dissent and peaceful environmental activism. She also highlighted that no copy of the detention order or the grounds for detention was provided to the family, which is mandated under Article 22(5) of the Constitution.

“Is India really free? In 1857, 24,000 Britishers used 135,000 Indian sepoys to oppress 300 million Indians under orders from the Queen. Today, a dozen administrators are misusing 2,400 Ladakhi police to oppress and torture 3 lakh Ladakhis under the orders of the MHA,” Gitanjali posted on X.

Gitanjali drew parallels between current events and historical oppression, highlighting how such actions resonate with past struggles for freedom in India.

The situation surrounding Sonam Wangchuk, a prominent scientist and activist in Ladakh, highlights significant tensions in the region, particularly related to demands for greater autonomy and recognition of statehood. Following Sonam’s arrest under the National Security Act (NSA) and ongoing protests fueled by unfulfilled government promises, the state of democracy and civil rights in India has sparked widespread concern.

  • Arrest Details:
    • On September 26, 2025, police entered Sonam’s home without a warrant, confiscated his belongings, and arrested him.
    • He was taken to Jodhpur Jail under the NSA, which allows detention without trial, raising alarms about civil liberties.
  • Sonam Wangchuk’s Advocacy:
    • Sonam has been a prominent figure in advocating for Ladakh’s inclusion in the 6th Schedule of the Indian Constitution, which would provide it with greater autonomy and protection of its unique culture and environment.
    • He has led peaceful protests and hunger strikes for over five years, demanding solutions to local issues such as job scarcity and environmental preservation.
  • Protests in Ladakh:
    • People have been protesting for years regarding local governance and rights. Despite peaceful protests, media attention only increased when violence broke out due to police actions on September 24, 2025.
    • The protests highlighted severe unemployment issues, with Ladakh experiencing a high unemployment rate of 26.5% for graduates.
  • Government Response:
    • The government responded to protests with arrests and accusations against Sonam, portraying him as an anti-national figure and a threat to national security.
    • Allegations were made regarding Sonam’s supposed ties to foreign entities and his participation in activities outside India. However, these have been cited as either taken out of context or distorted.
  • Media Manipulation:
    • There are concerns about the government’s use of social media and traditional media to discredit Sonam and those protesting.
    • Edited videos were circulated, misrepresenting his statements to portray him as disloyal or sympathetic to adversarial nations like China. This is frustrating, given that he has campaigned against Chinese products.
  • Personal Background of Sonam Wangchuk:
    • Sonam Wangchuk is an engineer and educator who founded the Students’ Educational and Cultural Movement of Ladakh (SECMOL), revolutionizing education in the region.
    • He is known for innovations like the Ice Stupa technique for water conservation and solar-heated tents for soldiers, proving his commitment to both local and national interests.
  • Supreme Court Involvement:
    • The Supreme Court of India issued a notice regarding Gitanjali’s plea, prompting the government to share the reasons for Sonam’s detention.
    • The hearing involved significant back-and-forth between Gitanjali’s attorney, Senior Advocate Kapil Sibal, and Solicitor General Tushar Mehta, representing the government.
  • Legal Arguments:
    • Sonam Wangchuk’s Rights: Sibal argued that the detention violates Sonam’s fundamental rights, including the right to fair legal processes.
    • Lack of Information: Gitanjali’s team raised concerns that she was not given details about the grounds for her husband’s detention, making it difficult to challenge the arrest.
    • Government’s Defense: The Solicitor General claimed that legal requirements were followed and that no medications were being withheld from Sonam.
  • Judicial Remarks:
    • A justice questioned why the grounds of detention were withheld from Sonam’s wife, suggesting that consideration should be given to allowing her access to this information.
    • The court established that Sonam should receive medical attention as per prison rules and that Gitanjali should be allowed to visit him.
  • Public Concern:
    • The public distress following Sonam’s detention, including reports of community members impacted by his arrest.
    • Gitanjali has indicated that there appears to be a deliberate effort to suppress Sonam’s advocacy for constitutional safeguards for Ladakh, suggesting that his detention is politically motivated.
  • Next Steps:
    • The matter is scheduled for further hearing on October 14, 2025, as the court continues to address Gitanjali’s requests and the government’s responses.

This case highlights significant issues around freedom of speech, the right to information, and government accountability concerning detainees’ rights and their families, especially in matters of national security.

Overall, this legal situation revolves around the urgent plea for the release of Sonam Wangchuk, with potential broader implications for civil liberties and advocacy in India.
