The big news is that Chief Justice Devendra Upadhayay and Justice Amit Borkar will be looking into the Public Interest Litigation (PIL) against Aditya Thackrey about the Sushant Singh Rajput and Disha Salian murder cases. This case is number 12 on the list for July 31, 2024, in front of the Chief Justice Bombay.
The respondents, the Central Bureau of Investigation (CBI) and State Police are required to submit their status report and update the High Court on the progress of the investigation in both cases.
The ‘Supreme Court & High Court & Litigants Association’, led by President Sh. Rashid Khan Pathan submitted this PIL in September 2023. In response to the PIL, Maharashtra’s Home Minister, Sh. Devendra Fadnavis, established a Special Investigation Team (SIT). The SIT includes Addl. Commissioner of Police Rajeev Jain, DCP Ajay Bansal, and Sr. P.I. Chimaji Adhav.
MLA Sh. Nitesh Rane objected to Sr. P.I. Shri Chimaji Adhav’s inclusion in the SIT due to integrity concerns and past handling of the Disha Salian case. Activists raised questions about Adhav’s involvement, pointing out the lack of an FIR or recreation of the scene of Disha Salian’s death despite the evidence. Allegations indicate that Adhav may be trying to shield the accused, Aditya Thackrey.
Malvani Police Station’s former IO is accused of falsifying investigation records in the Disha Salian case. According to the Bombay High Court ruling in Sudhir Vora vs. Commissioner of Police, Mumbai (2004 Cr. l. J. 2278), no officer from the implicated police station can conduct the investigation. The Hon’ble Bombay High Court ruling prohibits any police officer attached to the implicated police station from conducting the investigation
The High Court will consider the Public Interest Litigation (PIL) and three interim applications on the scheduled hearing date. Shri Aditya Thackrey, the main suspect, has submitted an intervention application (IA (St.) No. 19336 of 2023) to join the proceedings as a party respondent. The petitioner, Shri Rashid Khan Pathan, has filed an application (IA (St.) No. 19612 of 2023) requesting contempt and perjury actions against Aditya Thackrey and his legal representative due to the false affidavit submitted by Thackrey.
