COVID-19 Vaccine Deaths: Supreme Court Reserves Judgment on Petition for Compensation and Independent Prosecution

The Supreme Court of India has reserved its judgment on a batch of significant writ petitions demanding compensation for deaths allegedly caused by COVID-19 vaccines and calling for the constitution of an independent expert committee to investigate Adverse Events Following Immunisation (AEFI).

A Division Bench, comprising Justice Vikram Nath and Justice Sandeep Mehta, concluded extensive hearings after arguments from the petitioners, intervenors, and the Union of India regarding the scope of judicial intervention in national public health policy.

The petitions, filed by individuals including Rachna Gangu and Venugopalan Govindan, alleged that their family members died due to vaccine-related adverse effects.

Senior Advocate Colin Gonsalves, representing the petitioners, advanced the following core arguments:

  • Need for Independent Inquiry: Petitioners sought leave to amend their pleas to array a large volume of case studies and affidavits from medical professionals, contending that there has been a systemic under-reporting of serious vaccine adverse events across the country. They urged the formation of an expert, independent panel to reconcile discrepancies in reported fatality figures.
  • Compensation Policy: The Court also considered the Union’s appeal against an interim order of the Kerala High Court, which sought the formulation of a comprehensive compensation policy for such alleged fatalities.

Petitioners countered the Union’s claim that vaccination was purely voluntary, arguing that restrictions imposed by workplaces, educational institutions, and public access requirements rendered the jab effectively compulsory for many citizens.

Union of India’s Defense and Data

Additional Solicitor General (ASG) Aishwarya Bhati, representing the Union, staunchly defended the government’s vaccination policy and surveillance mechanisms.

The Union’s position was based on the following points:

  • The Union opposed the expansion of the petitions into a generalized challenge, asserting that issues of vaccine authorization, safety validation, and reporting mechanisms were thoroughly addressed in the Court’s 2022 judgment in Dr. Jacob Puliyel v. Union of India.
  • The ASG maintained that India’s adverse-event surveillance mechanism has received international recognition and that all reported AEFI cases are diligently examined by expert committees.
  •  The Union provided aggregate figures to illustrate the safety profile of the mass vaccination drive:
    • Total Doses Administered: Approximately 2.2 billion.
    • Total AEFI Cases Reported: 92,687 (equating to approximately 0.0042%).
    • Causality: The ASG submitted that available evidence does not establish a definite causal link between the administered vaccines and the deaths cited by the petitioners.

Court’s Observations

During the proceedings, the Bench, particularly Justice Nath, repeatedly pressed the petitioners to provide a strong empirical basis for their allegations, including the disputed claim that 33,000 deaths in the country were vaccine-related.

The Court questioned the viability of applying foreign data (such as U.K. statistics) to the Indian context and probed the petitioners’ stated distrust of official government health data.

The Court will now deliberate on the extensive submissions, which included support from intervenors like Advocate Prashant Bhushan for the demand for an independent probe.

The reserved judgment will determine three key outcomes:

  1. Whether the petitions will be allowed to be amended to formally include the demand for an independent inquiry.
  2. Whether the Supreme Court will mandate the constitution of an independent expert committee to review AEFI cases.
