During the hearing in the Bombay High Court in the Disha Salian case, Aditya Thackeray’s lawyer filed an affidavit claiming that he had received a clean chit from the CBI and other agencies, and that the case was also pending in the Supreme Court. Under these circumstances, it was unjust to pursue a case against Thackeray in the Mumbai High Court. Thackeray’s lawyer may have believed that filing such a contradictory affidavit would save Thackeray, but now the situation has backfired.
The Mumbai High Court told Thackeray’s lawyer that since you have filed affidavits, you must have the evidence for them. You should check with the CBI lawyer whether the CBI has ever investigated the Disha Salian case. Ishwar Thackeray’s lawyer, who is arguing in another court, questioned the CBI lawyer about this. The lawyer initially tried to evade the issue, but when he realized that the matter was sub judice, he sent the information to his Delhi office. The CBI office in Delhi sought advice from the Home Ministry regarding providing this information. The Home Ministry, which invited Amit Shah, clearly told the CBI that it was a health investigation agency and should inform the court of the actual situation. The Home Ministry is not here to protect or frame anyone. It is necessary to express its opinion as per its discretion.
The entire matter then turned upside down. The CBI’s Delhi headquarters informed the Mumbai CBI lawyer that the CBI had never examined the case related to Disha Salian’s death in any way.
The Bombay High Court raised serious questions about the investigation conducted by the Mumbai Police and the state government. The court stated that it was unfair to conduct an investigation for so many years under an Accidental Death Report (ADR) without registering an FIR. The Bombay High Court reserved its decision in the matter after hearing arguments from both parties.
It is noteworthy that Disha Salian’s father, Satish Salian, filed a petition in the Bombay High Court, demanding that his daughter’s death be declared a murder and harassment, rather than a suicide, and that an FIR be registered and a fresh investigation be conducted.
