During the ongoing hearing in the Bombay High Court in the Disha Salian death case, several serious and shocking questions have arisen regarding the security of witnesses, the police investigation, and the post-mortem report. While no official confirmation has emerged regarding a person named “Motu” or a special police officer acting as a government witness, some very serious aspects regarding the witnesses have been discussed by the court and lawyers. The key points of this entire case are outlined below:
1. Threats to the lives of witnesses and claims of secret witnesses: During the hearing, Nilesh Ojha, the lawyer representing Disha Salian’s father, Satish Salian, told the court that he has witnesses and evidence that could reveal the full truth of the case. However, he clearly stated that these witnesses’ lives are in serious danger. Therefore, their identities and testimony can only be presented before the court if the investigation is handed over to the Central Bureau of Investigation (CBI) and those witnesses are provided with strict police protection.
2. Bombay High Court issues sharp questions to Mumbai Police: During the hearing in August 2026, the Bombay High Court raised serious questions about the investigation conducted by the Mumbai Police and the Maharashtra government.
3. Why was an FIR not registered?: The court asked why the police did not immediately register an FIR when the father suspected his daughter’s murder and gang rape, and why did they continue the investigation for years, treating it as merely an “accidental death” (ADR)?
4. Doubts about the post-mortem and injuries: The court questioned the police, asking how a person who fell from the 14th floor could suffer only broken teeth instead of serious injuries or broken bones? Furthermore, the court expressed serious doubts about the absence of blood stains at the scene and the discrepancies between the Panchnama and photographs regarding the body’s clothing.
5. Allegations of concealment of documents: Disha’s father alleged that due to pressure from the then police officers and some leaders of the Maha Vikas Aghadi (MVA) government, he was not even given copies of the post-mortem and investigation reports for years.
6. Political allegations and counter-allegations: The case has also become quite heated. The petitioner has accused Shiv Sena (UBT) leader Aditya Thackeray’s team of exerting pressure and has demanded his questioning. Meanwhile, Aditya Thackeray’s lawyer, Sudip Pasbola, has described these allegations as entirely politically motivated and based on rumors. Currently, the Bombay High Court has reserved its decision after hearing arguments from both sides, and will soon decide whether the case will be investigated afresh or by the CBI.
