Disha Salian Case: Father Moves Bombay High Court, Alleging Gang Rape and Seeking FIR Against Aditya Thackeray and Others

The petitioner has presented vital evidence in his petition that reveals the deceitful actions of the Malvani Mumbai Police in fabricating records to protect Aditya Thackrey and others.

The petition also requests that, “If anything happens to me, this affidavit should be considered my final statement, and Aditya Thackrey and the other accused should be held responsible.” This highlights the seriousness of the claims and the petitioner’s concern for his own safety.

The petition also expresses gratitude towards a range of individuals and organizations, including:

  • “SSR Warriors” (supporters of justice for Sushant Singh Rajput)
  • Arnab Goswami of Republic Bharat
  • Ashutosh Pathak of Qvive Network
  • Prabhakar Surywanshi of AAkar- Digi 9
  • Sushil Kulkarni of Analyser

  • Rashid Khan Pathan
  • Adv. Nilesh Ojha
  • “All those who had played a crucial role in this battle.”

Furthermore, the petitioner extends his thanks to Prime Minister Narendra Modi, Home Minister Amit Shah, Chief Minister Devendra Fadnavis, Deputy Chief Minister Eknath Shinde, and then-NCB Mumbai Zonal Director Sameer Wankhede. He specifically requests the court to direct the Central Government to acknowledge the alleged “commendable work” done by Sameer Wankhede and reinstate him with a higher position within agencies like the NCB, NIA, ED etc..

The petitioner requested the High Court to instruct Sh. Sameer Wankhede to provide an affidavit containing all the key evidence against Aditya Thackrey, including the location of Aditya’s mobile tower. The petitioner also requested information on other high-profile suspects that Wankhede collected during his investigation.

In a sensational development, Shri Satish Salian, father of the late Disha Salian, has moved the Bombay High Court, seeking immediate registration of an FIR for gang rape and murder and demanding the arrest of Aditya Thackeray, Uddhav Thackeray, Rhea Chakraborty, and other accused persons.

The petition comes with strong forensic evidence, eyewitness testimonies, and call records that allegedly prove a systematic cover-up orchestrated by powerful individuals in politics, Bollywood, and law enforcement.

Shri Salian’s legal move threatens to expose one of the biggest conspiracies involving political elites, the police force, and media collusion, and could lead to the arrest of high-profile figures.

1. Disha Was Silenced to Protect Aditya Thackeray’s Dark Secrets

  • The petition alleges that Disha Salian was in possession of explosive information that would have exposed Aditya Thackeray and his crime syndicate.
  • Disha had witnessed a high-profile crime involving the sexual assault of a minor at a Bollywood party, allegedly attended by Aditya Thackeray, Sooraj Pancholi, and others.
  • She was murdered to ensure she never revealed the crime or the perpetrators involved.
  • Forensic evidence, eyewitness statements, and call records confirm that Disha was gang-raped and then killed before her body was placed near a building to stage a fall.

2. Forensic Proof: No Blood, No Fractures, No Suicide – Only Murder

Scientific and forensic evidence presented in the petition proves that Disha did not fall from the 14th floor but was murdered elsewhere.

Key findings include:

  • Eyewitnesses confirmed there was no blood at the impact site, which is scientifically impossible in the case of a fall from such a height.
  • Disha’s body showed no fractures, head injuries, or internal organ damage, further proving she never fell from the 14th floor.
  • Her funeral photographs and eyewitness accounts contradict the police’s claims, as her body was intact with no trauma typically seen in high-rise falls.
  • No blood stains were found on her clothes or the people who transported her to the hospital, contradicting the official narrative.

3. The Disha-Sushant Link: A Murder Conspiracy That Had Two Victims

  • The petition establishes a direct connection between Disha Salian’s murder and Sushant Singh Rajput’s suspicious death just five days later.
  • Sushant, after learning of Disha’s murder, was in extreme fear and told close associates that “they will kill me too.”
  • His behavior changed drastically—he stopped sleeping in his bedroom, frequently changed SIM cards, and confided in his staff that he was being followed.
  • Sushant had plans to expose the crime in a press conference, which sealed his fate.
  • Rhea Chakraborty, working for Aditya Thackeray, passed sensitive information to the accused, leading to a conspiracy to eliminate both Disha and Sushant.

4. Demand for CBI Probe and High Court Supervision

The petitioner seeks Bombay High Court’s intervention to:

1.    Register an FIR against Aditya Thackeray, Uddhav Thackeray, Rhea Chakraborty, and other accused under charges of gang rape, murder, and criminal conspiracy.

2.    Transfer the investigation to CBI under High Court supervision to prevent Maharashtra Police’s interference.

3.    Provide protection to all key witnesses, whistleblowers, journalists, and legal representatives, including whistleblower officer Sameer Wankhede.

4.    Arrest senior police officers of Malvani Police for obstruction of justice, evidence tampering, and shielding the accused.

5.    Recover all deleted case files, CCTV footage, and forensic reports that were manipulated.

6.    Transfer the case outside Maharashtra to ensure a free and fair trial.

5. Bombshell Evidence Against Aditya Thackeray and His Associates

  • Mobile tower data proves that Aditya Thackeray and Sooraj Pancholi were at the scene when Disha was murdered.
  • NCB Zonal Director Sameer Wankhede recovered chat records between Aditya Thackeray and Rhea Chakraborty, showing their involvement in the conspiracy.
  • The petition demands Sameer Wankhede be made a party respondent and directed to submit all digital and forensic evidence collected in the case.
  • A police sting operation by ACP A.P. Nipunge leaked to the media exposes how the post-mortem reports of both Disha and Sushant were manipulated.

Petion is having following prayers:-

PRAYERS : It is therefore humbly requested that this Hon’ble Court may pleased to;

(i)            Direct that this Petition be tagged along with PIL (st.) No. 17983 of 2023  filed by Supreme Court and High Court Litigants Association through its President Sh. Rashid Khan Pathan  as both the  matters pertain to the same issue.

(ii)           Registration of FIR Against Aditya Thackeray & Others :- Direct Respondent No. __, Commissioner of Police, Mumbai, to immediately register the written complaint dated 12.01.2024, given  by Shri Rashid Khan Pathan, as an FIR under Sections 376(D), 302, 201, 218, 409, 166, 120(B), 34, 107, 109, of IPC and under other penal provisions, against Aditya Thackeray and other accused persons.  

(iii)        Direct appropriate action under IPC and also under contempt against the concerned members of the SIT for their willful contempt of the guidelines issued by the Constitution Bench in Lalita Kumari v. Government of Uttar Pradesh, (2014) 2 SCC 1, and the binding directions of the Hon’ble Bombay High Court in Priya Gunaji Gaokar v. State of Maharashtra, 2014 SCC OnLine Bom 5139, by failing to register an FIR despite receiving a detailed complaint that explicitly discloses the commission of cognizable offences, including gang rape and murder.

(iv)        Transfer of Investigation to CBI & Supervision by This Hon’ble Court :- Direct the State of Maharashtra to hand over the entire investigation to the Central Bureau of Investigation (CBI) and further direct that the CBI to appoint an officer not below the rank of Inspector General of Police (IGP) to lead the investigation under the direct supervision of this Hon’ble Court to ensure impartiality, transparency, and adherence to due process.

(v)            Protection for the Petitioner, Key Witnesses & Legal Representatives :– Direct Respondent No. __, Commissioner of Police, Mumbai, to immediately provide adequate police protection to the Petitioner and his family members, Shri Rashid Khan Pathan, main complainant, Adv. Nilesh Ojha, Shri Ashutosh Pathak, Whistleblower officer Shri Sameer Wankhede, Other key witnesses, journalists, and activists actively working to uncover the truth.

(vi)         Scene Reconstruction of the Crime : Direct the Investigating Officer (IO) to immediately conduct a forensic scene reconstruction of the crime, in the presence of the Petitioner’s legal representatives and media reporters and produce the complete videography before this Hon’ble Court.

(vii)      To provide Previous enquiry  Reports of ADR :  Direct the Commissioner of Police, Mumbai, to immediately provide a copy of the earlier enquiry  report of accidental death, which was mandatory for them to be provided four years back.

(viii)     Disclosure of Mobile Tower Locations & Call Data Records of the Accused:- Direct the Commissioner of Police, Mumbai, to produce before this Hon’ble Court the mobile tower locations and Call Data Records (CDR) of the following individuals from 03.08.2020 to 20.08.2020: – Aditya Thackeray, Sooraj Pancholi,  Dino Morea,  Ekta Kapoor, Sachin Vaze, Rhea Chakraborty, Imtiyaz Khatri, Shovik Chakraborty, Aditya Thackeray’s police security guards and close friends, Rohan Rai, Himanshu Shikhare etc.

(ix)        Registration of FIR Against Aditya Thackeray, Kishori Pednekar & Others for Intimidation of the Petitioner and witnesses:-  Direct Commissioner of Police, Mumbai, to register a separate FIR against Aditya Thackeray, former Mumbai Mayor Kishori Pednekar, and others for:- Pressuring the Petitioner and his family to falsely implicate Union Minister Shri Narayan Rane and BJP MLA Shri Nitesh Rane in the case. – Threatening and coercing eyewitnesses to prevent them from testifying and – Creating a climate of fear to obstruct the investigation.

(x)           Affidavit from Shri Sameer Wankhede Regarding Key Evidence:- Direct Respondent No. __, Shri Sameer Wankhede, to submit a sworn affidavit detailing all the evidence he uncovered related to the present case, including: – Digital evidence (WhatsApp chats, call records, video footage). – Investigative findings on the accused’s involvement in various  organized crimes. – Details of political and other departmental  interference in the case.

(xi)          Recognition of Shri Sameer Wankhede’s Work & Provision of Protection – Direct Respondent No. __, Union of India (UOI) to: Acknowledge and appreciate the commendable service of Shri Sameer Wankhede  and Provide him departmental protection in line with the Hon’ble Supreme Court’s ruling in Ram Lakhan Singh v. State of U.P., (2015) 16 SCC 715.

(xii)       Interim Compensation for the Petitioner & His Family for Violation of Fundamental Rights:- Direct the State of Maharashtra to immediately grant appropriate interim compensation to the Petitioner and his wife for the violation of their fundamental rights to a fair investigation. Further, direct that the said compensation be recovered from the guilty police officers, as ruled in the case of S. Nambi Narayanan v. Siby Mathews, (2018) 10 SCC 804 and Veena Sippy v. Mr. Narayan Dumbre, 2012 SCC OnLine Bom 339.

(xiii)    Guidelines to Prevent Future Manipulation & Political Influence in Investigations :- Issue guidelines to ensure that:- State police or any government authority cannot protect or shield politically influential accused persons like Aditya Thackeray and Uddhav Thackeray and – Independent monitoring mechanisms are established for cases involving high-profile individuals.

(xiv)    Prosecution of Corrupt Police Officers and doctor for Misuse of Public money and government machinery :- Issue guidelines for the immediate prosecution of police officers under Section 409 IPC, who, instead of performing their public duties, misuse public money and government machinery for unlawful activities and shielding criminals.

(xv)      Transfer of Case Outside Maharashtra to Ensure a Fair & Impartial Trial – Direct the State authorities to file a writ petition before the Hon’ble Supreme Court for the transfer of the investigation and trial outside Maharashtra, given the high level of political interference and compromised law enforcement agencies and atmosphere of fear among the complainant and witnesses.

(xvi)   Direction to handover Disha Salian’s Mobile Phone & Laptop:- Direct the Commissioner of Police, Mumbai, to immediately return Disha Salian’s mobile phone and laptop to the Petitioner, which were unlawfully and dishonestly handed over to Sh. Rohan Rai .

(xvii)   Production of Post-Mortem Videos, Photos & CCTV Footage – Direct the Commissioner of Police, Mumbai, to produce before this Hon’ble Court: – Origional CCTv recordings of Disha’s society from date 03.06.2020 to 10.06.2020. – The complete video recording and photographs of Disha Salian’s post-mortem. – CCTV footage from all connected locations, including: Her residential society. All the hospital where she was taken and Any other relevant locations where evidence manipulation occurred.

(xviii) Investigation into Media Houses for Spreading False Narratives:- Direct the CBI to investigate the role of journalist Rajdeep Sardesai and media outlets like ‘News Laundry’ and ‘Live Law’ under Section 120(B) IPC r/w Section 10 of the Evidence Act, for their involvement in a well orchestrated conspiracy and their attempts to mislead the public, influence witnesses, and obstruct justice through biased reporting and spreading of false narratives, conspiracy theories with ulterior motive to save accused.

(xix)     Contempt Proceedings Against Dishonest Media Houses:- Take suo-moto  action against Rajdeep Sardesai, Live Law, News Laundry, and other dishonest media houses for their wilful and deliberate disregard  and contempt of the specific directions laid down in Nilesh Navalakha v. Union of India, 2021 SCC OnLine Bom 56.

(xx)      Direction to Media to Prevent Harassment and Unlawful Pressure on the Petitioner – Direct that all media houses, journalists, and news portals be prohibited from directly approaching, harassing, or pressurizing the Petitioner and his family for statements, interviews, or updates regarding the present case.

(xxi)   Further, direct that any official updates, press statements, or case developments be sought only from the Petitioner’s legal representatives, including his appointed advocate or Adv. Nilesh Ojha, to ensure that the Petitioner and his family are not subjected to media coercion, undue pressure, or psychological distress and the integrity of the investigation is not compromised by misleading media narratives or speculative reporting. And – No attempts are made to manipulate or influence the legal process by selective reporting, misinterpretation, or distortion of facts.
