During the West Bengal Assembly elections, TMC leaders, especially Abhishek Banerjee, launched a scathing attack on BJP leaders. They were under the illusion that their party, the TMC, would win and Chief Minister Mamata Banerjee would wipe out all their claims. However, their move backfired, and the Bharatiya Janata Party secured an absolute majority in West Bengal, replacing the TMC, and Subhendu Adhikari became Chief Minister. Following this, Mamata Banerjee’s nephew and Diamond Harbour MP, the outspoken Abhishek Banerjee, found himself surrounded by two sides. On one hand, a court case is pending against him for allegedly making inflammatory statements about Home Minister Amit Shah, while on the other, Subhendu Adhikari is determined to bulldoze him, claiming that his illegal properties have been discovered.
During the recently concluded West Bengal Assembly elections, an FIR was filed against TMC MP Abhishek Banerjee for allegedly making inflammatory and threatening statements about Home Minister Amit Shah. He filed a petition in the Calcutta High Court to quash this FIR. During the hearing, the Calcutta High Court strongly reprimanded his statements, calling them “irresponsible” and “inflammatory.” The court rejected his petition but granted him interim protection from coercive police action (e.g., arrest). The West Bengal Police was also barred from taking any punitive action against him in connection with his alleged remarks against Union Home Minister Amit Shah during election rallies.
This protection will remain in effect until July 31, or until the case is resolved. He will be required to cooperate with the investigation and comply with conditions such as not traveling abroad without court permission.
It is noteworthy that an FIR was registered against Abhishek Banerjee at the Bidhannagar Cyber Crime Police Station for allegedly making inflammatory speeches during the 2026 West Bengal Assembly election campaign.
According to the FIR, the case was registered on May 15th, based on a complaint filed by social activist Rajib Sarkar on May 5th, just a day after the election results were announced.
Rajiv Sarkar filed a complaint at the Baguihati police station, alleging that Abhishek Banerjee made inflammatory statements during several election rallies held between April 27th and May 3rd. The complaint further alleged that these speeches incited enmity, disturbed public peace, and directly threatened Union Home Minister Amit Shah. Rajib Sarkar also submitted links to several speeches along with the complaint.
Apart from court proceedings, the Suvendu Adhikari government has also gone after Abhishek Banerjee. During a speech, Chief Minister Suvendu Adhikari stated that he had obtained details of 24 illegal properties belonging to Abhishek Banerjee and was preparing to take action against him with a bulldozer. In this regard, West Bengal Chief Minister Suvendu Adhikari’s government has had the Kolkata Municipal Corporation (KMC) issue notices to investigate alleged illegal constructions and properties belonging to Abhishek Banerjee. Suvendu Adhikari’s stance on this action is that if violations of rules and illegal construction are found, bulldozers will definitely be used.
The following are the key developments regarding the Abhishek Banerjee property dispute.
Notice: The corporation has issued a seven-day ultimatum regarding alleged irregularities at the “Santiniketan” property on Harish Mukherjee Road and Kalighat Road properties in South Kolkata.
Scope of action: More than 24 locations and properties linked to Abhishek Banerjee are being investigated. TMC’s response: Abhishek Banerjee has retorted, saying that no matter who sends notices or demolishes his house, he will not bow to these threats, and that this is revenge politics.
Abhishek Banerjee is calling the case against him a political vendetta, while Chief Minister Suvendu Adhikari is calling it a major change in the corruption-free governance of West Bengal, rather than an act of political vendetta. In such a situation, whether Abhishek Banerjee is right or Chief Minister Suvendu Adhikari’s, this will be known only when Abhishek Banerjee is found guilty or acquitted in such a case. It is also possible that this may prove to be a mere show of treachery between two political parties, in which attacks and counter-attacks are carried out for show, but internally everything is in collusion.
