Awaken India Movement’s Public Notice: Challenging Unreasonable Nipah virus (NiV) Restrictions in India

The Awaken India Movement (AIM) has issued a formal Grievance Petition and Legal Demand Notice questioning the excessive restrictions, including mandatory testing/screening, social distancing mandates, and quarantine measures imposed during the alleged Nipah virus outbreak in West Bengal. The AIM argues that these measures violate fundamental constitutional rights and lack sufficient scientific backing.

The notice demands transparency, accountability, and scientific evidence from Indian health authorities, including the Union Health Ministry, National Centre for Disease Control (NCDC), and AIIMS, before enforcing further public health mandates.

Concerns Raised in the Notice

1. Questioning the Basis of Nipah Virus Restrictions

The AIM challenges the justification for imposing lockdowns, mandatory testing, mask mandates, and social distancing based on just two alleged Nipah cases in West Bengal. Citing the Indian Evidence Act (Section 74 & 75) and Epidemic Diseases Act (1897), the notice demands:

  • Scientific proof of Nipah virus isolation, transmission, and testing accuracy.
  • Evidence that masks and lockdowns effectively prevent Nipah spread.

  • Article 19 (Freedom of Movement & Work): Lockdowns restrict livelihoods.
  • Article 14 (Right to Equality): Selective business closures (e.g., schools vs. pharmacies) are discriminatory.
  • Article 21A (Right to Education): School shutdowns disrupt learning.

3. WHO & Government Overreach Allegations

The AIM accuses the World Health Organization (WHO) and Indian health agencies of orchestrating an unnecessary epidemic or pandemic scare without concrete evidence. The notice questions:

  • Why Indian traditional medicine (AYUSH) was sidelined in favor of allopathic interventions.
  • The legal basis for censorship of media and suppression of dissenting medical opinions.

4. Legal Actions & Non-Compliance Warning

The notice serves as:
